1. Who we are

This website is operated by Agentika, Sašo Vidmar, s.p., registered at Trubarjeva Ulica 42, 6330, Piran, Slovenia, registration number 7574746000 ("Agentika," "we," "us," or "our"). We are the data controller for the personal data described in this policy, meaning we decide why and how it is processed.

If you have questions about this policy or how your information is handled, see the Contact us section below.

2. Scope of this policy

This policy explains what information we collect when you use agentika.eu, including our free Gap Analysis chat, why we collect it, who it's shared with, and what rights you have over it. It applies to visitors of this website and to businesses who go through the Gap Analysis process, whether or not you become a client afterward.

This policy does not cover the practices of other websites you may reach through links on this site. See the "Links to third-party sites" section of our Terms & Conditions for more on that.

3. Information we collect

We collect information in two ways: what you tell us directly, and what our analysis tools gather automatically once you give us a starting point (your business name and website).

Information you provide directly

  • Your name. Used to personalize the conversation.
  • Your email address. Used to deliver your Gap Analysis and 12-month plan, and to follow up about it.
  • Your business name, as it appears on your Google Business Profile, if you have one.
  • Your website address.
  • Your business address and any additional service areas you tell us about. This field uses Google's address autocomplete, which means Google processes what you type as you type it. See Google's own privacy policy for how they handle that.
  • Self-reported business details, such as how many new clients you're aiming for per month, what share of your calls you currently answer live, and how quickly you typically follow up on missed calls or form submissions.

Information gathered automatically during the analysis

Once you provide the details above, our analysis process automatically gathers additional information to build your report. This includes:

  • A scan of your website's homepage, used to assess its structure and conversion readiness.
  • Publicly available data from your Google Business Profile, including your local search ranking and service area coverage.
  • Publicly available review data for your business, compared against a competitor in your area.
  • Whether your business currently runs Google Ads.
  • Search demand and keyword data relevant to your business and location.

Most of this second category is publicly available business information rather than personal data about you individually, but we're including it here for transparency, since it's gathered as part of the same process.

Information we don't collect

We don't currently ask for a phone number, payment details, or any government-issued identification through the Gap Analysis chat.

4. How we use it

  • To generate your personalized Gap Analysis and 12-month marketing plan.
  • To communicate with you about your plan, by email, and to answer questions you raise with us.
  • To provide, maintain, and improve our services if you choose to become a client.
  • To meet legal and accounting obligations we're subject to.

We do not sell your personal data to third parties.

5. Our legal basis for processing

Where the General Data Protection Regulation (GDPR) applies, we rely on the following legal bases:

  • Consent, for submitting your details through the Gap Analysis chat and receiving your report. You can withdraw this at any time, see Your rights below.
  • Performance of a contract, once you engage us as a client, to deliver the services you've signed up for.
  • Legitimate interests, for basic analytics on how our website is used, and for direct marketing follow-up about your plan, balanced against your right to opt out at any time.
  • Legal obligation, where we're required to retain certain records, for example for tax or accounting purposes.

6. Who we share it with

We use a third-party marketing analysis and client-management platform to power the Gap Analysis chat, generate your report and plan, and, if you become a client, to manage ongoing campaign delivery and reporting. That provider processes the information described in this policy on our behalf, under our instructions.

The name of this platform provider is available on request via the contact details below. We're not listing the specific vendor name on this public page, but as our data processor, they are contractually restricted to using your information only to provide the service to us and are not permitted to use it for their own purposes.

We may also share information with:

  • Google, when our tools query Google's APIs (Business Profile, Maps, Ads) as part of building your analysis.
  • Email and hosting providers we use to run this website and send correspondence.
  • Professional advisors such as accountants or lawyers, where necessary.
  • Authorities, where we're legally required to disclose information.

7. International transfers

Some of the providers listed above may process information outside the European Economic Area (EEA), including in the United States. Where that happens, we take steps intended to ensure your information receives a level of protection consistent with EU data protection law, such as reliance on the European Commission's Standard Contractual Clauses or an equivalent safeguard with the relevant provider.

[Confirm with each processor, including your analysis platform provider, whether they offer a Data Processing Agreement with Standard Contractual Clauses, and update this section to reference it specifically once confirmed.]

8. How long we keep it

We keep information from a Gap Analysis for as long as reasonably necessary to respond to your enquiry and, if you become a client, for the duration of our engagement plus a reasonable period afterward for legal, accounting, and dispute-resolution purposes.

As a general default, if you don't respond to your Gap Analysis or become a client, we aim to delete or anonymize your information within 24 months of your last contact with us. You can also ask us to delete it sooner, see Your rights below.

9. Your rights

Depending on where you're located, you may have some or all of the following rights over your personal data:

  • Access. Ask us for a copy of the personal data we hold about you.
  • Correction. Ask us to correct inaccurate or incomplete information.
  • Deletion. Ask us to delete your personal data, subject to certain exceptions (for example, information we're legally required to keep).
  • Restriction. Ask us to limit how we use your data in certain circumstances.
  • Portability. Ask us for your data in a structured, commonly used format, or to have it transferred directly to another provider.
  • Objection. Object to processing based on legitimate interests, including direct marketing.
  • Withdraw consent. Where we rely on consent, withdraw it at any time without affecting anything we did before you withdrew it.

To exercise any of these rights, contact us using the details in Contact us below. If you're not satisfied with how we've handled your request, you have the right to lodge a complaint with your local data protection authority. If you're in Slovenia, that's the Information Commissioner of the Republic of Slovenia.

10. Cookies

[This section needs to be confirmed against how the live site actually works. If the site uses any cookies or similar tracking technology, whether for analytics, the chat widget, or advertising, list each category here (strictly necessary, analytics, marketing) and how visitors can control them, and add a cookie consent banner if required. If the site currently uses no cookies beyond what's strictly necessary to load the page, state that plainly instead.]

11. Children's privacy

Our services are directed at business owners and are not intended for children. We don't knowingly collect personal data from anyone under 16. If you believe a child has provided us with personal data, please contact us and we'll delete it.

12. Changes to this policy

We may update this policy from time to time, for example to reflect changes in our practices or for legal reasons. We'll update the "Last updated" date at the top of this page when we do. If changes are significant, we'll take reasonable steps to let you know.
